Agreement to Terms

By accessing or using Industrial Fitness Queenstown's facilities and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Membership and Access

Membership Requirements

• Members must be at least 16 years of age
• All members must complete a health and fitness questionnaire
• Valid payment method must be maintained for recurring memberships
• Members must comply with all facility rules and regulations

Access Cards

• Access cards are non-transferable and for member use only
• Lost or stolen cards must be reported immediately
• Replacement cards may incur a fee
• Sharing access cards is strictly prohibited and may result in membership termination

Payment and Billing

Membership Fees

• Membership fees are billed in advance on a recurring basis
• Prices are subject to change with 30 days notice
• All fees are in New Zealand Dollars (NZD)
• No refunds for partial months or unused time

Payment Methods

We accept credit cards, debit cards, and direct debit. You authorize us to charge your payment method for all applicable fees. Failed payments may result in membership suspension.

Cancellation and Freezing

Membership Cancellation

• Written notice required for cancellation (email acceptable)
• Minimum 14 days notice required
• No refunds for prepaid memberships
• Contract terms apply to fixed-term memberships

Membership Freeze

• Members may freeze their membership for medical or travel reasons
• Minimum freeze period: 2 weeks
• Maximum freeze period: 3 months per year
• Freeze fees may apply

Facility Rules and Conduct

General Rules

• Proper athletic attire and closed-toe shoes required
• Equipment must be returned to designated areas after use
• Wipe down equipment after use
• Mobile phone use for calls should be limited to designated areas
• No outside personal training without prior authorization

Prohibited Conduct

• Harassment, discrimination, or intimidation of any kind
• Damage to equipment or facilities
• Use of performance-enhancing drugs or substances
• Photography or video recording without consent
• Aggressive or disruptive behavior

Health and Safety

Assumption of Risk

You acknowledge that physical exercise involves inherent risks. You assume all risks of injury or property damage arising from your use of our facilities and services.

Medical Clearance

You represent that you are physically fit and have no medical conditions that would prevent safe participation. We recommend consulting with a physician before starting any exercise program.

Emergency Procedures

In case of emergency, notify staff immediately. We reserve the right to call emergency services if necessary. You authorize us to seek medical treatment on your behalf in emergencies.

Liability and Indemnification

To the fullest extent permitted by law, Industrial Fitness Queenstown, its owners, employees, and contractors shall not be liable for any injuries, damages, or losses arising from your use of our facilities or services.

You agree to indemnify and hold harmless Industrial Fitness Queenstown from any claims, damages, or expenses arising from your use of our facilities or violation of these terms.

Personal Training and Classes

Booking and Cancellation

• Class bookings must be made through our booking system
• Cancellations must be made at least 12 hours in advance
• Late cancellations may result in loss of class credit
• Personal training sessions require 24 hours notice for cancellation

Class Conduct

• Arrive on time; late entry may be refused for safety reasons
• Follow instructor guidance at all times
• Inform instructors of any injuries or limitations
• Respect other participants and maintain appropriate space

Intellectual Property

All content on our website and in our facility, including logos, graphics, text, and software, is the property of Industrial Fitness Queenstown and protected by copyright laws. Unauthorized use is prohibited.

Privacy

Your use of our services is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms.

Termination

We reserve the right to terminate or suspend your membership at any time for violation of these terms, non-payment, or conduct that we determine to be detrimental to our business or other members.

Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
